Terms of Service

1. Acceptance of Terms

By accessing or using Deep Draft ("the Service"), available at deep-draft.com as a web application, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Deep Draft is a production management tool designed for YouTube gaming creators. The Service helps you manage your video production pipeline, including project tracking, script writing, research, analytics, deal management, and AI-assisted content creation. Deep Draft is a web application, accessible on desktop and mobile browsers.

Features and functionality may change over time as we develop and improve the product. We will make reasonable efforts to communicate significant changes, but we reserve the right to modify, add, or remove features at any time.

3. User Accounts

To access certain features, you must create an account using magic link authentication (email-based sign-in). By creating an account, you agree to:

Provide a valid email address that you own or control.
Maintain only one account per person. Creating multiple accounts to circumvent limits or restrictions is not permitted.
Keep your account access secure. You are responsible for all activity that occurs under your account.

Some features are available without an account, using local device storage only.

4. Subscription and Billing

Deep Draft offers both a free tier and a premium subscription:

Free tier: Access to core features with limited AI credits.
Premium subscription: Available at $12/month or $96/year, billed through Stripe. Premium includes full AI features, cloud sync, and additional capabilities.
Free trial: New premium subscribers receive a 14-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will begin and you will be billed at the applicable rate.
Cancellation: You may cancel your subscription at any time through your account settings or Stripe's customer portal. Upon cancellation, you will retain access to premium features until the end of your current billing period. No refunds are issued for partial billing periods.

Prices may change with reasonable notice. Any price changes will apply to billing periods starting after the change takes effect.

5. User Content

You retain full ownership of all content you create in Deep Draft, including but not limited to projects, scripts, ideas, research notes, deal information, and revenue data ("User Content"). We do not claim any intellectual property rights over your User Content.

By using the Service, you grant Deep Draft a limited, non-exclusive license to store, process, and transmit your User Content solely for the purpose of providing the Service to you. This includes cloud syncing your data across devices and processing content through AI features when you choose to use them. This license ends when you delete your content or your account.

You can export or delete your data at any time through the Settings screen.

6. AI Features

Deep Draft includes AI-powered features such as script generation, idea synthesis, hook suggestions, SEO analysis, and style learning. These features are powered by third-party AI providers (Anthropic, OpenAI, and Groq). Regarding AI-generated content:

AI-generated content is provided as a starting point and creative aid. It is not guaranteed to be accurate, original, or suitable for any particular purpose.
You are solely responsible for reviewing, editing, and publishing any content that incorporates AI-generated material.
When you use hosted AI features (powered by Deep Draft's API key), your prompts and content are sent to the AI provider for processing. See our Privacy Policy for details.
AI features consume credits on the free tier. Premium subscribers have expanded access.

7. Bring Your Own Key (BYOK)

Deep Draft allows you to use your own API keys for third-party services including Anthropic (Claude), OpenAI, Groq, ElevenLabs, YouTube Data API, and RAWG. When using your own keys:

Your API keys are stored locally on your device only. They are never transmitted to Deep Draft's servers.
You are fully responsible for the usage, costs, and security of your own API keys.
Deep Draft is not liable for any charges incurred through third-party providers when using your own keys.
You must comply with the terms of service of each third-party provider whose API keys you use.

In addition, when you connect a YouTube channel or use YouTube-powered features, you agree to be bound by the YouTube Terms of Service. Deep Draft's use of YouTube API Services is also subject to the Google Privacy Policy.

8. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws.
Attempt to gain unauthorized access to the Service, other users' accounts, or our systems.
Scrape, crawl, or use automated tools to access the Service beyond normal application use.
Interfere with or disrupt the Service or the servers and networks that host it.
Reverse engineer, decompile, or attempt to extract the source code of the Service.
Use the Service to generate content that is illegal, harmful, or violates the rights of others.
Resell, sublicense, or redistribute access to the Service without written permission.

9. Termination

We reserve the right to suspend or terminate your account if we reasonably believe you have violated these terms, engaged in abusive behavior, or are using the Service in a way that could harm other users or the Service itself. Where possible, we will provide notice before taking action.

You may delete your account at any time. Upon deletion, your cloud-synced data will be removed from our servers. Data stored locally on your device is under your control.

10. Availability and Backups

We aim to keep Deep Draft available and reliable, but we do not guarantee 100% uptime. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We strongly recommend keeping local backups of important work.

11. Limitation of Liability

To the maximum extent permitted by law, Deep Draft and its developer are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event shall Deep Draft or its developer be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, even if advised of the possibility of such damages.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Deep Draft and its developer from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these terms.

13. Changes to These Terms

We may update these Terms of Service from time to time. When we make changes, we will update the "Last updated" date at the top of this page. Continued use of the Service after changes are posted constitutes your acceptance of the revised terms. For significant changes, we will make reasonable efforts to notify you via email or an in-app notice.

14. Governing Law

The Service is operated by Deep Draft. These terms shall be governed by and construed in accordance with the laws of the State of Kansas, United States, without regard to its conflict-of-laws principles. Any disputes arising from these terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Kansas, and you consent to personal jurisdiction in those courts.
